Welcome to the official e-commerce site for David Schaefer, Wildlife Artist, operated by DDGI LLC. Please read these Terms and Conditions ("Terms") carefully before using our website and purchasing any of the exquisite bronze sculptures or other Products offered ("Products"). By accessing or using the site, you agree to be bound by these Terms.


1. General Conditions and Scope

a. Agreement to Terms: These Terms govern your use of the website and constitute a binding legal agreement between you and DDGI LLC. ("we," "us," or "our").

b. Changes to Terms: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. The "Last Updated" date at the top of this page will be revised accordingly. Your continued use of the site after any changes constitutes acceptance of the new Terms.

2. Product Information and Sales

a. Artist's Work: David Schaefer has received international recognition for his ability to capture in bronze, the power and majesty of his animal subjects from around the world. His works are noted for their meticulous detail and dramatic intensity.

b. Product Representation: We make every effort to display the Products as accurately as possible. However, the exact color, finish, or scale may vary slightly from what you see on your screen due to photographic lighting, your monitor settings, and the unique, handmade nature of the bronze casting process and patina. All weights and measurements are approximate.

c. Pricing and Availability:

  • All prices are subject to change without notice.
  • We reserve the right to limit the sales of our Products to any person, geographic region, or jurisdiction.
  • We reserve the right to discontinue any Product at any time.

d. Order Acceptance: Your placement of an order does not necessarily ensure that we will accept your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to pricing and availability, errors in the description, or an error in your order.

3. Payments, Shipping, and Delivery

a. Payment: 100% of the purchase price is due at the time of the order.  We accept payment via Visa, Mastercard, and American Express. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the site.

b. Shipping:

  • Shipping and handling costs are included in the purchase price.

c. Delivery:

  • Delivery within 10 weeks after order and 100% payment. We are not responsible for delays caused by the shipping carrier.
  • Risk of loss and title for items purchased from the site pass to you upon delivery.

International Orders: For international orders, you are solely responsible for any applicable tariffs levied by your country..

4. Returns, Refunds, and Cancellations

a. Return Policy: Due to the high value and sensitive nature of bronze artwork, all sales are considered final unless the artwork arrives damaged or defective.

b. Damaged Products: If a Product arrives damaged, you must contact us at gdye@davidschaefersculptures.com within 3 days of delivery with detailed photographic evidence of the damage to both the artwork and the packaging. We will determine, at our sole discretion, the appropriate remedy (repair, replacement, or refund).

c. Cancellations: You may request a full refund within 48 hours of placing an order and completing payment. After this window, it is not possible to cancel your order.

5. Intellectual Property and Copyright

a. Ownership of Art: The entire content published on this site, including but not limited to the artwork, designs, images, text, and overall presentation, is the property of DDGI LLLC or its content suppliers and protected by U.S. and international copyright laws.

b. Artwork Copyright: The purchase of a bronze sculpture or other Product does not transfer the copyright or any other intellectual property rights in the work. DDGI LLC retains all rights, title, and interest in the artwork's design, composition, and reproduction rights.

c. Prohibited Use: You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the site or any of the artwork images without express written permission from us. This includes using images of the artwork for commercial purposes, non-fungible tokens (NFTs), or any digital or physical reproductions.

6. Disclaimer of Warranties; Limitation of Liability

a. No Warranties: We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, or error-free. The Products are provided 'as is' and 'as available,' without any warranties or conditions of any kind, either express or implied, including all implied warranties of merchantability, quality, and fitness for a particular purpose, except were prohibited by law.

b. Limitation of Liability: In no case shall DDGI LLC, our employees, or agents be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from your use of any of the Products procured using the service.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions.
